End User License Agreement

By downloading, installing, or using this software, you agree to be bound by the terms of this license agreement. If you do not agree to these terms, do not download, install, or use the software.

1. Definitions

"Software" means the ESTË Live and ESTË Studio applications, including all binary executables, libraries, documentation, and associated files distributed by the Licensor.

"User" means any individual or entity that downloads, installs, or uses the Software.

"Licensor" means Sergio Ferraresi, the author and copyright holder of the Software.

"Content" means audio recordings, session files, mix configurations, and any other data created by the User using the Software.

2. Grant of License

The Licensor grants the User a free, non-exclusive, non-transferable, worldwide license to use the Software for any purpose, including personal and commercial use. There is no limit on the number of installations or users. No license key, activation, or registration is required.

3. Restrictions

The User shall not:

Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software
Redistribute, sublicense, rent, lease, or lend the Software to third parties — the Software may only be obtained from the official website (este.audio) or other channels designated by the Licensor
Remove, alter, or obscure any copyright notices, trademarks, or other proprietary notices contained in the Software
Create derivative works based on the Software
Use the Software to develop a competing product

4. Intellectual Property

All intellectual property rights in the Software, including but not limited to copyrights, trademarks, trade secrets, and patents, remain the exclusive property of the Licensor. The source code is not provided and is not part of this license. This license does not grant the User any ownership rights in the Software.

5. Ownership of Content

All Content created by the User using the Software belongs exclusively to the User. The Licensor claims no rights over the User's Content. The User is free to use, distribute, and commercialize their Content without restriction.

6. Local Network Access

ESTË Live operates a local network (LAN) server to enable remote control of audio mixing via web browsers on the same network. ESTË Studio operates entirely offline with no network communication. The Live network functionality:

Does not require or use any internet connection
Does not transmit data outside the local network
Does not connect to any cloud service or external server
Is limited to devices on the same local network as the host machine

7. Privacy

The Software does not collect, store, or transmit any personal data. There is no telemetry, analytics, usage tracking, crash reporting, or any other form of data collection. Both applications operate entirely offline and locally. The Software may periodically check for updates by requesting a small file from the official website; this request contains only standard HTTP headers and no personal information.

8. Disclaimer of Warranties

The Software is provided "as is", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. The Licensor does not warrant that the Software will be error-free, uninterrupted, or free of harmful components.

9. Limitation of Liability

In no event shall the Licensor be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, business interruption, or any other commercial damages or losses, arising out of or in connection with the use or inability to use the Software, even if the Licensor has been advised of the possibility of such damages.

The Licensor's total liability under this agreement shall not exceed the amount actually paid by the User for the Software (which is zero).

10. Donations

The Software is free. Donations are entirely voluntary and do not constitute a purchase of the Software or any service. Making a donation does not entitle the donor to:

Technical support or priority assistance
Guaranteed software updates or new features
Any specific functionality or feature requests
A refund or chargeback right

Donations are gratuitous contributions to support the continued development of the Software. The Licensor is under no obligation to use donations for any specific purpose.

11. Termination

This license is effective until terminated. It terminates automatically if the User violates any term of this agreement. Upon termination, the User must destroy all copies of the Software in their possession. Sections 4, 5, 7, 8, 9, 10, 12, and 13 survive termination.

12. Governing Law

This agreement is governed by and construed in accordance with the laws of Italy. Any disputes arising from or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts at the developer's place of residence.

13. Severability

If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable, while preserving the original intent of the parties.
